What is Legal Malpractice?

Legal malpractice is when a lawyer breached his or her duty of care to the client and the client was harmed as a result. 
In Florida, according to Statute 95.114 an injured party must make a claim:

WITHIN TWO YEARS.
(a) An action for professional malpractice, other than medical malpractice, whether founded on contract or tort; provided that the period of limitations shall run from the time the cause of action is discovered or should have been discovered with the exercise of due diligence. However, the limitation of actions herein for professional malpractice shall be limited to persons in privity with the professional.

 If your lawyer made a mistake, causing you to lose your case or settle for less than you deserve, you have up to two years to make a claim against that attorney or firm.  

Can I Sue My Lawyer?

Yes, absolutely, however legal malpractice is one of the most complex areas of litigation and you need to assure you have an attorney who is knowledgeable in professional liability, and is willing to sue another lawyer. 

Why is it so complex?  A legal malpractice attorney must prove  you would have won your original case, but for the action or inaction of your previous lawyer.
